All copyright, design rights and intellectual property rights existing in our designs and products and the images, texts and design of our website/marketing material are and will remain the property of Midland Leisure Sales. We will treat any infringement of these rights seriously.
INTELLECTUAL PROPERTY RIGHTS - COPY RIGHT LAW - IMPORTANT
The act of copying or adapting someone else's work is a restricted area. Any adoption will be legally regarded as a derived work, so if you simply adapt the work of others, it is still their work and they have every right to object.
Unauthorized use of the Work is an infringement of the Copyright, Design and Patents Act 1988. Please be aware that the Act provides for strict liability, meaning that you can be found liable regardless of your level of knowledge of the infringement or your intent.
Anyone found to have not sought permission or obtain a license from our company constitutes an infringement of our copyright in the Work.
Anyone found to have adopted our artwork/design will be sent the following:
To rectify this infringement, we will require that you undertake to:
1. Immediately cease infringing our copyright.
2. Provide Midland Leisure Sales full costs for the use of my work to date.
3. Enter into a license with Midland Leisure Sales for future use of our work.
4. Deliver all originals or copies of my work to our premises including any infringing copies.
Midland Leisure Sales have a legal system in place to deal with anyone/person/company (big or small). We will pursue any case through legal channels which are all set-up and available to us, we have access to a solicitor and IP Solicitors within the hour, so can deal with issues fast.
If you see anyone copying our work/products please let us know it’s misleading to our customers and the general public and also called ‘passing off’
There is nothing to stop anyone being inspired by the work of others but when it comes to your own work start with a blank sheet and not to copy what others have done.
It is an offence to perform any of the following acts:
Copy the work:
Rent or lend copies of the work
Perform or show work in public
Adapt the work
New design: To qualify as new design the overall impression should be different from any exciting design.
Any drawings, artwork, images, ideas, designs supplied to a potential or existing customer by Midland Leisure Sales remain our company sole property and shall not be published or disclosed to any other person without our written permission.
Please be aware Midland Leisure Sales will take appropriate action to protect and safeguard our rights in the Work. This may include, without limitation an injunction and or proceedings to recover damages and an account of profits.
Please think before your copy or post images on any social media sites, we do regular checks and we will name and shame any company found guilty.
We don’t like copy cats who think it’s acceptable to take our work/designs and copy our products after putting in hours and hours and years and years of hard work into our designs and products. These companies have no imagination and think it’s acceptable to steal, but please think again!
